Can I File a Personal Injury Claim if I’ve Been Attacked by a Dog?

Cherie Davis • August 28, 2020

Animal attacks can happen quite unexpectedly and can cause severe injuries. Animal attacks are not all that common, but attacks from ‘man’s best friend’ are much more frequent. Sadly, our canine friends can be a threat to the public. Dog attacks are on the rise. If an animal has attacked you or a loved one, you may be able to file a lawsuit.

PERSONAL INJURY ATTORNEYS LAKE CHARLES, LA

Suppose you have experienced an attack from a dog that is known for being a threat or danger to the public. In that case, your chances of receiving compensation for your injuries, pain, and suffering could be a lot easier, as appropriate precautions and preventions were clearly not taken by the owner. In this situation, the dog owner could be deemed negligent and be liable for any injuries caused by their pet.

Dangerous Dogs

The Dangerous Dogs Act of 1991 was enacted to protect the public from specific breeds of dangerous dogs. These animals have to be kept on a lead and muzzled in public. They must also be registered, insured, neutered, tattooed, and microchipped.

If these dog breeds injure a citizen, a successful compensation claim is likely, even if the dog had no previous signs or history of aggression. An insurance policy may cover these dog breeds in the event of a bite or attack. If there is no insurance coverage, a claim can be filed against the owner.

If attacked or bitten, you can also file a claim against any other breed of dog. The canine doesn’t need to be registered under the Dangerous Dogs Act of 1991 for a  claim to be filed after the injury or harm.

Report the Attack
If you are injured in an animal or dog attack, you should always report it to the law enforcement. You might not be the only person who was attacked by that particular dog. By informing the police, you make them aware of the potential for danger from that animal. The police have an obligation to take safety measures to keep the public safe from the dog’s attacks.

Making a Claim

Make sure to get specific details after the attack occurs, including:

  • The pet owner’s information, including his or her name and address
  • The police report, the incident number, and the police station details.
  • Whether or not the dog was covered by an insurance policy (the police will likely check into this during their investigation, but it’s still a good idea to have this information for yourself)

In the aftermath, also make sure to get medical care and documentation of your injuries. This is vital evidence that may be necessary to support your claim for compensation of medical bills, lost wages, and pain and suffering.
